CEDO nu ia masuri provizorii in cazul Calin Georgescu c. Romania

Curtea Europeana a Drepturilor Omului (CEDO) a anuntat astazi, printr-un comunicat, ca a decis, in mod unanim, sa nu adopte masuri provizorii in cazul Calin Georgescu impotriva Romaniei. Cazul a fost dezbatut de o Camera compusa din sapte judecatori.

Calin Georgescu a solicitat CEDO anularea deciziei Curtii Constitutionale a Romaniei (CCR) si reluarea alegerilor prezidentiale cu un nou tur. In acest context, judecatorii Curtii au subliniat faptul ca, conform articolului 39 din Regulamentul CEDO, masurile provizorii sunt aplicabile doar in situatii in care exista un risc iminent de vatamare ireparabila a unui drept prevazut de Conventie.

Judecatorii au mentionat ca, avand in vedere natura acestor drepturi, repararea lor nu ar fi posibila, iar persoana care le invoca nu ar avea posibilitatea de a fi repusa in situatia anterioara sau de a obtine despagubiri corespunzatoare. De asemenea, este important de retinut ca masuri provizorii nu pot fi adoptate decat in circumstante exceptionale, atunci cand exista un interes evident pentru partile implicate sau pentru a asigura buna desfasurare a procedurii legale.
